FormAI is a product of Exceev Consulting (Paris), built with Exceev Technology (Casablanca) ("FormAI," "we," "us," or "our"). Exceev Consulting is the contracting party for these Terms and the seller for every paid subscription — it is the name that appears on your card statement. These Terms of Service ("Terms") govern your access to and use of the FormAI platform at formai.app, including our website, applications, APIs, and related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
FormAI is an Exceev Consulting product, and your use of it is also governed by the Exceev Consulting Terms of Service and Privacy Policy. By creating an account or using the Service, you confirm that you are at least 16 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
FormAI provides an AI-powered platform for creating surveys, quizzes, live sessions, and interactive forms, with response analytics and team workspaces. Current capabilities include AI form generation, conversational editing, AI-generated themes, 27 question types, and presenter-led live sessions. Roadmap items are not part of the Service until FormAI makes them available. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

The Service and its original content, features, and functionality are owned by Formai Inc and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all content you create using the Service. By using the Service, you grant us a limited license to host, store, and display your content solely to provide and improve the Service. We will not use your User Content to train machine learning models without your explicit, opt-in consent.
You retain ownership of any data you submit to the Service ("Your Data"), including forms, themes, and responses you collect. When respondents submit data through forms you publish, you act as the data controller under the GDPR with respect to that response data. You are responsible for collecting any required consent, providing appropriate privacy notices to your respondents, and honoring data-subject requests. We will handle Your Data in accordance with our Privacy Policy.
Certain features of the Service may require a paid subscription. Payment terms, pricing, and billing cycles are presented at the time of purchase. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with at least 30 days' advance notice. Pro and Business subscriptions are purchased through self-serve checkout and do not include a free trial: your subscription begins and your first payment is charged as soon as checkout completes, and it renews automatically each billing period until you cancel. You may upgrade, downgrade, or cancel at any time — mid-cycle upgrades are prorated to the day, while downgrades and cancellations take effect at the end of your current billing period. The Free plan requires no card and can be used to evaluate the Service for as long as you like.
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may temporarily suspend access to the Service for maintenance, updates, or other operational reasons with reasonable notice when possible.
To the maximum extent permitted by applicable law, Formai Inc and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the amount you paid for the Service during the twelve (12) months preceding the claim.
To the extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do commit to reasonable security measures including encryption in transit and at rest, processing personal data in accordance with our Privacy Policy and the GDPR, and addressing critical bugs that affect data integrity or availability promptly. Statutory consumer rights are not affected by this disclaimer.
We will provide at least 30 days' notice before suspending or terminating your account, except where immediate suspension is necessary for security or legal compliance. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and data at any time by contacting [email protected] — we will process verified deletion requests within 30 days and confirm completion via email.
These Terms shall be governed by and construed in accordance with the laws of France. Exceev Consulting is registered with the Paris Trade and Companies Register under RCS Paris 951 589 639. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
We may update these Terms from time to time. Material changes will be notified at least 30 days in advance via email or a prominent in-app notice. You may reject changes by discontinuing use during the notice period; continued use after the notice period constitutes acceptance of the updated Terms.
